Around 20 urbanisations in the Marbella area are waiting for municipal permission to install gates and other “dissuasive” elements.
The municipal boundaries of Marbella are populated with many and various urbanisations, some of them very remote and those who live there are requesting the installation of gates, fences and other “dissuasive” elements.
The council has yet to pass the proposed by-laws which would allow them to do this.
Angeles Muñoz, mayor of Marbella, has commented that “the elements requested by the urbanisations would, and should, not cut off citizen’s access to the countryside but rather should be a protective and dissuasive barrier to anyone contemplating a crime on a remote urbanisation”.
The rules governing the installation of barriers on public roads contemplate the necessity of all citizens to be able to get through them 24 hours a day and 365 days a year; this guarantees the right of all citizens to be able to access any public area at any time.
Muñoz went on to underscore the fact that allowing urbanisations to install dissuasive measures would not mean that the road was not available for use by all members of the public.
Urbanisations built entirely on private land and with private roads can do what they wish.
