DMV: No makeup for boy's license photo

(CNN) -- The mother of a 16-year-old filed a federal lawsuit against the South Carolina Department of Motor Vehicles on Tuesday claiming her son was sexually discriminated against when he was forced to remove his facial makeup for a driver's license photo.


Chase Culpepper, 16, was born a male but is gender nonconforming. He regularly wears makeup and clothing typically worn by women, according to the lawsuit.


After passing his driver's test in June, Chase went to have his license photo taken. But an employee at the office asked him to remove his makeup.


The employee told Chase he couldn't wear "a disguise" and didn't look "like a boy should," the teen told CNN affiliate WYFF.


The lawsuit says Chase was discriminated against based on the employee's gender stereotypes and Chase's constitutional rights to freedom of speech and expression were violated.


The state DMV said in June it had a policy specifying the requirements for the photograph.


"At no time will an applicant be photographed when it appears that he or she is purposely altering his or her appearance so that the photo would misrepresent his or her identity," the policy says.


"That's been the policy since August of 2009," spokeswoman Beth Parks said.


"Stage makeup is not acceptable because it can be used to alter appearance. Regular everyday makeup is accepted because it's used to highlight or hide blemishes," she said.


The lawsuit says the photo policy is vague and overbroad because of its use of the term "identity."


The suit alleges the employees have interpreted it "to prohibit a male applicant from wearing regular everyday makeup that they allow female applicants to wear under the same policy."


"Chase Culpepper is entitled to be himself and to express his gender nonconformity without interference from the South Carolina DMV," said Michael Silverman, the executive director of the Transgender Legal Defense and Education Fund.


"It is not the role of the DMV or any government agency or employee to decide how men and women should look. Chase should be able to get a driver's license without being subjected to sex discrimination," Silverman said Tuesday at a joint press conference with Culpepper and his mother.


Calls and emails to the state DMV communications office were not immediately returned late Tuesday.


The lawsuit is not seeking damages or money but asking that changes be made to the DMV's photo policy and that Chase be allowed to retake his license photo while wearing his everyday makeup.

ISIS has released a gruesome video which apparently shows the beheading and horrific murder of freelance journalist 31-year-old Steven Sotloff.


The killing, which remains unverified by security agencies, follows weeks after journalist James Foley’s murder and echoes the exact same methodology.


The suspected executioner, believed to be the same who executed James Foley, could be seen in the video and photographic stills released by ISIS wearing the same clothing, dressed in complete black, his face cowardly covered, wearing sand coloured desert boots and gripping a combat knife in his left hand.


The executioner is heard to say with a British accent “Obama, I am back”.


Steven Sotloff, dressed in an orange jumpsuit similar to those worn by detainees in the Guantanamo Bay high security detention centre, is then heard to say: “You know who I am by now and you know why I am here.”


The executioner is then seen to pass the knife across Steven Sotloff throat before the video fades out. The video continues with the severed head being placed on the blood stained body.


A further person is seen in the background of the video with suggestion that this person may be a possible third suspect.


The video ends with the executioner saying: “Obama, back off and just leave us alone”.

€800,000 invested in Axarquia beaches over the last three years


THE Central Government in Spain has invested a total of €808,769 in improvements to the Axarquia beaches over the last three years, according to information presented by the councillorof Torrox Town Hall, María Baena.


The biggest expenditure has been aimed at the four largest tourist towns, Nerja, Torrox, Véléz-Málaga and Rincon de la Victoria, with the majority (€369,316) going to Véléz-Málaga.


The investment from the Central Government along the Axarquia coastline, reaffirms the importance of tidying up and cleaning the beaches in the province in order to optimise tourism along the eastern part of the Costa del Sol.



Neanderthal engraving discovered in Gibraltar


AN engraving which has been discovered in Gorham’s Cave in Gibraltar provides the first evidence found in the world that Neanderthals were as sophisticated as humans. The engraving, which dates back over 40,000 years, bears a remarkable resemblance to the children’s game of noughts and crosses.


The geometric pattern was identified by a team of researchers, after uncovering the engraving beneath undisturbed sediments that have also yielded Neanderthal tools.


Unlike our childhood beliefs that Neanderthals were brutes who had few basic skills, this new evidence suggests that their intellectual abilities have most definitely been underestimated. Recent findings intimate that they intentionally buried their dead, consumed a varied diet, adorned themselves with feathers and painted their bodies with black and red pigments, although we are yet to find answers as to why they did these things, questioning whether it was a form of art or a way of camouflaging themselves from danger.


Archaeologists have yet to call the engraving a piece of art, but said it was the first “deliberate, non-functional abstract etching” on a cave wall by someone who was not a modern human.


Professor Clive Finlayson, the director of Gibraltar Museum said “It brings Neanderthals even closer to us. It talks of high cognitive mental capacities in Neanderthals which are equivalent to humans.”

(CNN) -- When it comes to the creatures most likely to be spotted swimming down London's River Thames, hippos will be far down the list.


Until now.


Thanks to Dutch artist Florentijn Hofman, eagle-eyed visitors to London might just spot the three humps of an enormous hippo appearing from the Thames' murky depths.


Hofman is known for his super-sized, colorful works of art, most recently the enormous inflatable rubber duck that floated around the waters of cities like Hong Kong, Sao Paulo, Auckland and Osaka.


Earlier this year, Hofman was asked to create a piece of artwork by the organizers of Totally Thames, an annual festival that celebrates London's famous river.


He says he started by researching the history of the river, and eventually came across studies on hippo evolution that revealed its waters were awash with the large creatures hundreds of thousands of years ago.


The result was an artwork he's christened with a pun almost as heavy as one of the beasts he's been studying: "HippopoThames."


"I wanted to use the hippo to get people out of their homes, away from the Internet and the TV, and to explore London with a new perspective."


Not that creating a giant replica of an ungainly water mammal in one of the UK's busiest waterways is an easy business.

Cocktail of ingredients


"I was thinking about the history, but I also had to think about practicalities," Hofman says.


"We needed to make sure it could fit under various bridges as it had to be towed into place, so it's a cocktail of ingredients: the history of London, cost and the size of the space available."


Like several of Hofman's other pieces, "HippopoThames" was inspired by everyday objects -- in this case a children's book that the artist's parents gave him for their grandchild.


"One page had an illustration of a hippo and I saw it and thought that it could work really well. So the installation is something which is partly inspired by a found object," he says.


It's a process Hofman has used in the past, chiefly the enormous cuddly toys that formed his 2009 exhibition at The Hague and the ornament-like sparrow statues he created for Belgium's Rock Werchter music festival.

"'These pieces were inspired by children's toys or items picked up from flea markets I've visited -- mass-produced toys and animal ceramics," he says.


"It's not just about the animal -- it's about the outer skin. I'm all about beauty and the design of an object and I like to use and change these found objects by giving them different skins.


"I love the fact that so many of them are made in China and Taiwan.


"They're sent to the U.S. and Europe and they're in the hands of children for just a few minutes. I have a love for these objects and the way they get circulated around the world."


Settting is also key.


"I have a love of beautiful places -- both urban and rural, and I like to show them in their natural state," the artist explains.

Giant yellow bunny


Hofman claims an enormous yellow bunny he installed in the town of Orebro, Sweden, helped highlight a largely forgotten statue it was sited next to.


"The bunny was removed after three months but afterward, more people started to visit the spot. That's the B-side of my installations: they give the public space back to the people who then see it with a new perspective."


Hofman's work has taken him all over the world and certain destinations have left their mark.


"I love Sao Paulo," he says. "I love the people.


"Every morning you wake up and you meet people who become your friends.


"It's a concrete jungle where, as a human, you're downsized, but I like the strength and the love of the people and the way they live together."


The West African country of Senegal also makes his list of favorites, as does the Swiss town of Bern, largely because of the way residents interact with its river in the summer.


"It's the biggest artwork you can make - it's a social, natural thing and it changes people's perspective of the city."


Different nationalities react to his work in different ways, he says.


"In Europe, the first question will be about the cost. In Asia and South America people will ask, 'what is it and why is it there?'"

"In Asia, people work six or seven days a week, perhaps two jobs a day. They'll have Sundays off and they make the most of their spare time.


"In those rare moments they enjoy life to the max and are more open to certain things.


"If people have less spare time they feel they should make full use of it.


"In Europe, people work hard but they have more spare time and there's a different pace. People tend to be more spoiled."


Florentjin's own spare time on the sidelines of the London festival is likely to spent in one of the city's pubs, he says.


"I love the pub life in London, as well as the parks. If you step into any pub, people will talk to you.


"It's quite open, and they have a wonderful sense of humor -- you can have a great evening socializing."


Hofman says "HippopoThames" will be his final water-based project.


It appears that the popularity of his most recent project was a double-edged sword.


"After the rubber duck it was hard to come up with another water-related installation," he says.


"People just want another duck!"

(CNN) -- Jimi Jamison, who belted out the hits "The Search is Over" and "Burning Heart" for 1980s rock band Survivor, has died. He was 63.


"The entire Survivor family is very shocked and saddened by the passing of our brother Jimi Jamison," the band's official Facebook page said. "Our thoughts, love and prayers go out to his family and friends."


Jamison joined the band in 1984 after Survivor scored the No. 1 hit "Eye of the Tiger," from the "Rocky III" soundtrack. Original lead singer Dave Bickler left the band for medical reasons.

Jamison sang on five Top 20 singles. In addition to "The Search is Over," which peaked at No. 4, and "Burning Heart," which made it to No. 2 on the charts and was on the "Rocky IV" soundtrack, Jamison provided vocals for "I Can't Hold Back," "High on You," and "Is This Love."


Survivor disbanded in 1989, according to the band's biography on AllMusic.com.


Survivor returned to the studio in 1993 with Bickler back on lead vocals to record a couple of new songs for a greatest hits package. Jamison later rejoined the lineup in 2000.


Fans of TV's "Baywatch" might also recognize his voice. He sang and helped pen the show's theme song, "I'm Always Here."
